Anyone wishing to learn more about the program of U.S. Social Security Totalization Agreements, including details of some existing agreements, should indicate below: It should be noted, as a caution, that the waiver is quite rarely invoked and is invoked only in mandatory cases. The intention is not to give workers or employers the freedom to routinely choose coverage contrary to the normal rules of the agreement. If a company is established in both States Parties pursuant to paragraph 1 of this Article, the competent authorities of the Contracting States shall endeavour to clarify the matter by mutual agreement and to determine whether the company is established in any year of income or in any year of income. If the competent authorities are not in a position to make such a finding, the company shall not be treated for the purposes of the Convention as a company established in either of the two Contracting Parties. . . .
